Development (Building Safety) Amendment Act 2006


The Development (Building Safety) Amendment Act 2006 was passed by State Parliament on Wednesday 6 December 2006, and proclaimed on 14 December 2006.

The Act makes a technical change to the Development Act regarding the ability of a relevant authority (eg local council) to require work to be done to improve the safety of a building it considers unsafe while considering a development application for alterations or additions to the building.

The legislation was originally written to apply only to buildings built prior to the commencement of the (then) new Development Act on 15 January 1994. This amending Act allows that date to be altered (by Regulation) to ensure authorities can also require work to be done regarding any safety issues that emerge following approval and construction of buildings built later than that date.

On 14 December 2006 the Development (Building Safety) Variation Regulations 2006 were gazetted. These altered the date so that an authority can now require work to be done to improve the safety of a building it considers unsafe while considering a development application for alterations or additions to that building, for all buildings built before 1 January 2002.
