Building Consent Only
Carports, verandas, swimming pools and more approved in 20 days
There are also some residential development matters which, for safety reasons, the Government believes require building approval, but which should not be caught up in planning red tape.
We are creating a new list of matters which require building consent but not planning consent (this is called the ‘complying development - building consent only’ list).
Providing the building plans submitted meet Building Code requirements, a building consent will be issued for this sort of development within 20 working days of an application being lodged.
From 1 March 2009 the ‘building consent only’ list will include:
- Carports to 40m2 (with some conditions)
- Sheds to 40m2 (with some conditions)
- Verandas (with some conditions)
- Swimming pools and spas (with some conditions)
A complete list of proposed ‘complying development - building consent only’ appears at Appendix B of the Draft of the Residential Development Code.
Building Consent Only will not apply in State Heritage Places, State Heritage Areas, Local Heritage Places, or Historic (Conservation) Zones or Policy Areas.
Building rules consent may be granted by a local council or by a qualified private certifier of building work. Applications for building rules consent are assessed against the provisions of the Building Rules as they apply in South Australia.
A Development Approval must be issued by council within five working days of a building consent being granted.
Draft 'Building Consent Only' list
Draft lists of matters to be on the ‘Exempt’ and ‘Building Consent Only’ lists have been released together with a Draft of the Residential Development Code for testing and comment until 12 September 2008. The lists appear as Appendices in the Discussion Draft of the Code.
These lists will be finalised in October, with the new ‘Exempt’ list expected to come into effect from 1 January 2009 and the ‘Building Consent Only’ list expected to come into effect from 1 March 2009. Stage 1 of the Code expected to be active from 1 March 2009. Further consultation on subsequent stages of the Code’s implementation will occur later.
